What Must a Company Do When There's a Data Breach?

The company has to report the data breach to the ICO (Information Commissioner’s Office) without undue delay. If the company reported the breach later than 72 hours after it’s been aware of it, they have to give a valid reason. 

By the Data Protection Act 2018, the company is obligated to inform its affected customers by the data breach without undue delay. They also should explain to you what are the consequences of the data breach and what are the procedures taken or to be taken to eliminate any damage. 

Can I Get a Compensation for a Data Breach?

If you’re a victim of a data breach, you may be able to claim compensation. You can claim compensation if you’ve suffered from material (financial loss) or non-material (distress) damages. 

It’s recommended to complain about the data breach to the ICO. The ICO will investigate the incident and fine the company if they’re at fault for the data breach.
