What is Data Theft?

All your data can be found on the systems of the different companies you deal with. These companies are obligated to keep your personal data safe by the Data Protection Act and the General Data Protection Regulation (GDPR).

When a failure to adequately protect your personal data occurs, it can cause you serious damage; emotionally and financially. Victims of data theft have the right to make data theft claims in compensation for their losses.

Data theft or data breach means stealing digital information stored on computers, servers, or any electronic device. This leads to exposure of confidential or sensitive information to an unauthorised person.

The consequences of data theft are devastating for both the individuals and the organisations. On the individual’s level, this can lead to financial loss, identity theft, and severe emotional distress. On the company’s level, this can result in ruining their reputation and extreme financial loss.

What Are Data Theft Claims and Can I Make One?

Under the General Data Protection Regulation (GDPR), you have the right to claim compensation if your data is misused, stolen, disclosed, lost, or destroyed and you’ve suffered financial loss or emotional distress as a result.

You can make a data theft claim whether it’s an individual data breach case or a bigger case involving thousands of victims. The allowed period to make a data theft claim is six years and it’s one year if it involves a breach of human rights.

Are Companies Liable for Data Theft?

Companies are responsible for protecting their customers’ data stored on their systems. If a company fails to keep this information safe, then it’s liable for data theft, especially if it has a weak security system.

The problem can also be because of employee misconduct with private information. Companies have to take action to solve the problem after a data breach by one of their employees.

All this information goes under the term ‘personal data’ which means any information that identifies a person directly or indirectly. This term was defined in the Data Protection Act 2018.

Frequently asked questions & Useful InfoQuestions we are frequently asked by our users

What Must a Company Do When There's a Data Breach?

The company has to report the data breach to the ICO (Information Commissioner’s Office) without undue delay. If the company reported the breach later than 72 hours after it’s been aware of it, they have to give a valid reason.

By the Data Protection Act 2018, the company is obligated to inform its affected customers by the data breach without undue delay. They also should explain to you what are the consequences of the data breach and what are the procedures taken or to be taken to eliminate any damage.

Can I Get a Compensation for a Data Breach?

If you’re a victim of a data breach, you may be able to claim compensation. You can claim compensation if you’ve suffered from material (financial loss) or non-material (distress) damages.

It’s recommended to complain about the data breach to the ICO. The ICO will investigate the incident and fine the company if they’re at fault for the data breach.

The ICO won’t help you to get compensation. Although their investigations might take a lot of time, it can help a lot with your case.

Do I Have to Go to Court to Get Compensation?

You might reach an agreement with the company responsible for the data breach and get compensation from them without involving the ICO. But if the company refuses to pay, you have to take the claim to court. The court will decide whether the company should pay you or not.

We highly recommend taking independent legal advice to know if your case is strong enough or not before you take your claim to court. Our job is to refer you to the adequate legal advisor for your case.

How Much Compensation Will I Get for a Data Breach?

The court will decide how much will you get as compensation for a data breach. This relies on different elements:

  • The seriousness of the infringement regarding the sensitivity of the data stolen and its impact on you.
  • How many unauthorised people accessed your data.
  • The occurrence of any financial losses.
  • The emotional impact on you, such as anxiety and distress.
  • How long the company took to inform you of the breach.
  • The length of the unauthorised access of your information.

If you fail to demonstrate the damage you’ve experienced emotionally or financially in court, you may be awarded no compensation. In this case, you may be ordered to pay the other party’s cost. That is why we recommend your data theft claim is handled by an expert, introduced to you by Data Breach Claims, who will usually work for you on a no win, no fee basis.
