You could claim compensation worth thousands if your data was affected by the Equifax data breach that occurred in 2017.
Consumer credit reporting agency Equifax experienced a data breach in 2017 that saw the company fined £500,000 by the ICO, but the amount of compensation in the UK could add up to over £100 million. The data breach incident was carried out by cyber criminals who successfully accessed Equifax’s systems in America and stole the personal information of a reported 146 million individuals worldwide, including the personal data of an estimated 15 million of its UK customers. As a result of the cyber incident, which was announced in September 2017, those affected are eligible to make an Equifax data breach claim for compensation. Anyone affected by the breach would have received a letter from Equifax informing them of the breach, though it is possible that you did not receive the notification and could still be able to claim, especially given that the company admitted later that many more may have been affected.
We can put you in touch with expert data breach solicitors who are putting together a group claim whereby the large number of Equifax customers can be part of a collective claim for Equifax data breach compensation. Even if the breach has not led to any direct financial losses to you, you are still entitled to claim compensation for distress caused by the data breach. The exposure of sensitive data – typically used by the company when carrying out credit checks – could be considered a serious breach and one for which compensation could be significant.
The ICO in tandem with the Financial Conduct Authority discovered multiple failures at Equifax which led to personal information being retained for longer than is necessary and left vulnerable to unauthorised access. While any compensation is unrelated to the actual amount of the fine, the fact that they were given a penalty greatly enhances the prospect of a successful Equifax data breach compensation claim.
