In March 2021, retail company Fat Face was reported to have sent an email to its customers informing them of a breach that had been discovered two months earlier in January. This email was sent to thousands of affected customers and stated that their private data had been accessed by an unauthorised third-party user for a limited period of time.
Fat Face requested in the email that customers keep quiet about the breach and explained the attack was ransomware, and they had paid a ransom to a cybercrime gang for their system to be decrypted and the stolen data deleted. The personal details that were compromised during the attack were said to include customer names, addresses, email addresses, and partial credit card information. A separate email was sent out to staff members, notifying them that their bank account details, and National Insurance numbers might have been involved in the breach.
If you are one of the many customers or staff members affected by the Fat Face data breach, you could be eligible to make a claim for compensation. Fat Face’s notification to their impacted customers seems to be delayed at best, which raises more questions about whether the company followed all of the correct procedures, both in terms of security and notification.
In any case, the victims whose private data was exposed were left vulnerable to further fraudulent attacks like phishing and could make a claim for any losses and emotional distress they experienced as a result of being part of the breach. We can put you in contact with experienced data breach solicitors who are starting a collective group claim that will bring together the significant number of Fat Face customers who were part of this attack.

Customers have the right to expect that any personal or financial data that they have shared with an organisation, such as Fat Face, is securely stored and handled. When data protection standards have been below standard, and in this case a hack has enabled unauthorised access to your personal data, you can make a claim for compensation.
Normally, UK GDPR laws require organisations to disclose data breaches within 72 hours of the incident occurring or when the company becomes aware of it. Customers and some staff had a long wait before they were informed of the personal details that were affected in the data breach, and as well as this, the company also said in their email, “keep this email and the information included within it strictly private and confidential”.
Fat Face did not handle the breach in accordance with GDPR and what the ICO recommends as best practice. This is because it was reported that Fat Face paid a ransom of $2 million to the cybercriminal gang following the breach, which goes against the standard advice to not give in to these types of demands.
Therefore, starting a data breach claim against Fat Face will not only give you access to compensation, but also hold them to account for their actions. As a result, this will hopefully prompt them to take the necessary steps to improve their data security measures to ensure that such a breach cannot occur again.
If you have been notified by Fat Face that your data was affected in this attack, or you suspect you might have been involved, contact us today. We will put you in touch with specialist data breach solicitors who investigate your claim and confirm whether it can be taken further. Even if the breach has not led to any direct financial losses to you, you can still make a claim for compensation for the distress the data breach has caused you.
