In February 2021, popular gym franchise Total Fitness experienced a cyberattack in which customers personal data was breached including bank account information. They stated that usernames, passwords, and credit card information were not affected, however a scanned copy of customer membership agreements was taken. These agreements included the members addresses and bank account details with the information going as far back as 2018.
If you were one of the Total Fitness members involved in this breach you could be at risk and are eligible to make a claim for compensation. Customers should stay alert as criminals may attempt to contact them using stolen contact information, this is known as a phishing attack. Victims of a data breach like this are now exposed to greater risk of fraud, theft, and scams.
Total Fitness contacted all members whose data was involved in the breach by email. If you think you might have been part of the breach but don’t have an email from Total Fitness be sure to check your spam folder.
We can put you in touch with expert data breach solicitors who are putting together a collective group claim that will bring together the large number of Total Fitness members. If you are a Total Fitness member and received notification about involvement in the data breach, you are eligible to join our group claim.
Even if you have not experienced any financial loss during this breach, compensation is still payable for any distress you may have experienced as a result of the data breach. The personal data that was accessed could lead to other fraudulent activity like phishing attacks and those that were affected might have suffered some anxiety and distress about that.

Bringing a data breach claim not only gets you access to compensation, but also holds a company or organisation to account for their actions. As a result, this will usually prompt them to take the necessary steps to boost their data security measures. Total Fitness needs to be held accountable for insufficient security that allowed for a cyber attack to happen. Customers have the right to expect that any organisation they share their personal or financial data with will store and handle it in a safe and protected manner. When data protection standards have not been met, customers are entitled to receive compensation at least for emotional distress.
With enough information, cyber criminals could apply for credit in your name, set up fraudulent bank accounts and access your existing accounts. Both bank account details and home addresses were exposed in this case which increases the risk. There are signs you can look out for which suggest your data has been stolen, these include:
To protect yourself and your data from cybercriminals it is important to be vigilant and take the necessary steps if you think your information has been breached. In particular, check your bills and avoid clicking on links or downloading attachments from suspicious emails.

Keep in mind that data regulations mean that you have a right to compensation for non-material damage. This means those affected are entitled to compensation for the stress, frustration, and anxiety associated with the breach.
Our recommended experts will act for you on a No Win, No Fee basis, meaning there is no risk to you in making a claim and nothing to pay in the unlikely event we take on your claim and you don’t win compensation.
